Notice of Non-Discrimination

Reporting Discrimination

Per Santa Fe Public Schools Board of Education Policy 330, the District has the following methods to report incidents of discrimination:

1. Any student who believes he/she has been the target of discriminatory or harassing conduct by another student or by a school employee, or any person with knowledge or belief of such conduct toward a student should immediately report the alleged acts to a teacher, counselor, principal, other District employee, or the appropriate District official listed in policy 330.

2. Any District employee who suspects or receives notice that a student or group of students has or may have experienced prohibited conduct shall immediately notify the campus principal or the appropriate District official listed in policy 330.

3. Reports should be done in writing using the District Complaint Form(En español, haga clic aquí) A copy of this form will be submitted to the appropriate school official or district official, as designated below.

4. Students are not required to report discriminatory or harassing conduct to the person alleged to have committed the conduct. Reports concerning such prohibited conduct may be directed to the Superintendent. A report against the Superintendent may be made directly to the Board. If a report is made directly to the Board, the Board shall appoint an appropriate person to conduct an investigation. 

Investigating Discriminatory Conduct

Per Santa Fe Public Schools Board of Education Policy 330, the district will appropriately and promptly investigate all reports of discrimination. School principal or designee must accept and investigate all reports of discrimination and harassment.

Investigation Time Frame

Per Santa Fe Public Schools Board of Education Policy 330, the investigation will be completed within twenty (20) school days, and if the investigation requires more time, the administrator (or investigator) will inform the parties involved. The principal (or investigator) shall make a written report to the Superintendent upon completion of the investigation. If the complaint involves an alleged misconduct by certified personnel, any necessary reports shall be filed with the NMPED, Educator Ethics Bureau. The report shall include a determination of whether the allegations have been substantiated as factual and whether they appear to be violations of this policy. A copy of the completed report will be maintained by the school site.

Retaliation and Confidentiality

Per Santa Fe Public Schools Board of Education Policy 330, the District prohibits retaliation by a student or District employee against a student alleged to have experienced discrimination or harassment, or a student who, in good faith, makes a report of harassment or discrimination, serves as a witness, or participates in an investigation. The right to confidentiality, both of the complainant and the accused, shall be preserved consistent with applicable laws.

False Complaints or Claims

Per Santa Fe Public Schools Board of Education Policy 330, a student who intentionally makes a false claim or offers false statements regarding complaints of discrimination or harassment shall be subject to appropriate disciplinary action.
